3.  RUSSELL JONES3 DANIEL (GENERAL ALLEN2, CAPTAIN ALLEN1) was born 1796 in Danielsville, Madison County, Georgia, and died July 03, 1880 in Jackson County, Georgia.  He married ELIZABETH GILBERT April 06, 1815 in Franklin County, Georgia.  She was born Abt. 1796 in Franklin County, Georgia, and died Aft. 1860.   Notes for RUSSELL JONES DANIEL:
THE HISTORY OF MADISON COUNTY, GEORGIA
Named for his maternal grandfather Russell Jones.   Russell Jones Daniel operated the Ferry across the Broad River in 1839 and lived near Danielsville, Georgia.   He was a legal resident of Jackson Co. on October 19, 1840 (P. 336, deed Record Book G, Jackson Co. Georgia.) He owned 754 1/2 acres of land in Madison Co., (Early History of Jackson Co., Ga. by G.J.N. Wilson, P.331-332),   "Russell was a representative from Jackson Co. Ga. in the General Assembly 1842, 1843, no session 1844, 1855-56 and 1859-60."   Named for his Paternal Grandfather.   State Senator 1829-1830   A slave of Russell's, named Charles, was tried, and executed, in 1827 for attempted murder of his master; Russell Jones Daniel.   Russell furnished a $6,000 bond in 1832 in Inferior Court, Madison County, Ga. in regards to his father's, General Allen Daniel, mental competency hearing.   Russell was fined $2.00 in 1826 for assault and battery. {CRM}   Listed in 1820 Madison County Census, p 47, as head of household

Notes for ELIZABETH GILBERT:
Elizabeth's father, John Gilbert, died in Franklin county Georgia in 1804. Her uncle, Isaac Strickland, became the administrator of the Gilbert estate. Her mother was guardian until 1815 when first Isaac Strickland and then the Daniels became guardians of her siblings, John and Nancy Gilbert. Her oldest child was born in 1816 and the youngest born in 1841. That is a twenty-five year span. While this seems a wide span to me, it does not seem unusual for families in that place and time. She is listed in the 1860 Jackson county Ga census as 64 with her husband, at 65, an overseer, a one-year old niece, and two teenage children (17 & 14 years old and attending school). Since their youngest would have been 18-19, these may have been grandchildren. Elizabeth's brothers, John and William Gilbert, are listed as 1820 heads of households in Madison county. I have no details or dates of her birth or death. Another Elizabeth Gilbert, probably her niece, married an Isaac Strickland. Their 11 children were born starting Feb 25, 1836 to Jun 15, 1859. This Isaac is probably the son of Mary Strickland's brother, Isaac, who died in Danielsville Ga on Jan 23, 1857. {BAS}   Diane Carrington Bradford

"In 1840, the Grand Jury issued the following indictment, "John Scott, Jr. and James S. Gholston on the third day of September, 1840 in Danielsville, Georgia unlawfully did fight together and contend to the terror of the citizens and disturbance of the public tranquility, contrary to the Laws of said State, the good order, peace and dignity thereof." James served in the military as the Captain of and organized Co. A, "Madison County Greys,", 16th Regiment Georgia Volunteer Infantry, CSA, on Jul 11, 1861 in Madison County, Georgia. His twin sons enlisted in Co. A with him, and another son enlisted in a different regiment. James was elected Major Feb 1, 1862; Lieutenant Colonel Aug 16, 1864, and retired to Invalid Corps Aug 24, 1864. He was captured at Gettysburg, interrred at Johnson Island, Ohio, and paroled at Athens, Georgia, May 8, 1865.   [Apparently James was promoted to full colonel sometime before the Battle of Gettysburg because hhis name is listed on the Civil War Soldiers and Sailors System as an officer of the 16th Regiment along with the other full colonels. Its companies were raised in the counties of Madison, Elbert, Gwinnett, Habersham, Jackson, and Hart. Sent to Virginia the regiment was assigned to General H. Cobb's, T.R.R. Cobb's, Wofford's, and DuBose's Brigade. It fought with the Army of Northern Virginia from the Seven Days' Battles to Gettysburg, then moved with Longstreet but was not engaged in the fight at Chickamauga. After serving at Knoxville, it returned to Virginia and participated in the conflicts at The Wilderness, Spotsylvania, and Cold Harbor. Later the unit was part of Early's operations in the Shenandoah Valley and the Appomattox Campaign. The regiment had a force of 488 effectives in April, 1862, lost 11 killed and 50 wounded at Malvern Hill, and of the 368 engaged at South Mountain, fifty-two percent were disabled. It sustained 70 casualties at Fredericksburg, 133 at Chancellorsville, and twenty-six percent of the 303 at Gettysburg. The 16th lost many at Sayler's Creek and surrendered 2 officers and 51 men. Its commanders were Colonels Goode Bryan, Howell Cobb, James S. Gholston, and Henry P. Thomas; Lieutenant Colonel B. Edward Stiles; and Major John H. Skelton.    In his book on the Golson family, Black said, "...James Gholston organized one of the three companies that went from Madison County during the Civil War, and he served as Captain of the company. Later he served as Major. The company was called 'The Flint Hill Grays.'  James was embroiled in a lawsuit at the time of his death relative to an unpaid promissary note. Seems as if he had some trouble paying his bills. According to the suit, there was a Mrs. A. Gholston who had also signed the note suggesting a third marriage.   CSA, 16th GVI, Company A Civil War; CSA; Capt; 16th Georgia, Co A (Madison County Greys) Captured at Gettysburg Interrred at Johnson Island, Ohio ; Major Feb. 1, 1862 ; Lt. Col. Aug. 16, 1864.   Owned 11 slaves in 1860.   Found not guilty of Wife whipping in 1860.   On Sept. 3, 1840, John Scott, Jr. and James S. Gholston had a public fight. They were both fined $35.

From Tabor's Historyof Madison County, Georgia, pg 139:   "One of the most involved divorces [in Madison Co] was between Jane and James S. Gholston. Jane was a widow, a Mrs. Harris, with considerable property taken over by her new husband. James S. Gholston was a prominent citizen, a Justice of the Inferior Court, a member of the Convention for Secession, Captain of the Madison County Greys, the first volunteers from the County in the Civil War. The two did not get along well. Jane Gholston was given a divorce in 1860 and granted $5000. In September 1865 James S. Gholston petitioned for a reduction in alimony which was granted. When the reducted amounts were not paid regularly, the case was taken to the Supreme Court where Jane won, getting the land and mill she owned prior to marriage. This property had been sold or mortgaged by James S. Gholston. Another appeal to the Supreme Court was favorable to Jane Gholston. No record of James S. Gholston has been found after 1870 and no person interviewed in Madison County had any knowledge about him."

Richard served in the military enlisting as a private in Co. A, 11th Regiment, Georgia Cavalry, CSA, in Nov 1864 in Athens, Georgia.   11th Regiment, Georgia Cavalry   11th Cavalry Regiment was organized near Athens, Georgia, in November, 1864, by consolidating the newly formed 30th Georgia Cavalry Battalion and four companies raised under the authority of the War Department where the conscript act could not be enforced. The unit was assigned to the Department of South Carolina, Georgia, and Florida, and served in M.W. Hannon's and R.H. Anderson's Brigade. It fought at Savannah, but many of the men were captured. In February, 1865, only 90 effectives were present and in April most of these were captured at Macon. Colonel Andrew Young, Lieutenant Colonel H.W.
