The Right to Privacy; the biggest in our nation's history

I think for far too long we have had to deal with concepts that are being forced down our throats that being disguised as being part of the US Constitution. Two of these liberal concepts are Separation of Church and State and Right to Privacy. No where in the US Constitution does either of these two concepts appear in meaning or wording.

Instead we are stuck with judges that use these two concepts to justify their decisions on the bench. Not only do they use these two concepts to for the basis for their rulings but they also use other foreign countries laws to form the basis for some decisions (example; over turning of Sodomy Laws in Texas and other States).

I am getting so tired of hearing the Bush bashers and liberals bellyaching about the Patriot Act and the laws that they say infringe on their rights and yet they don't say a thing when activist judges use nonsense excuses that don't exist to justify over turning law just to satisfy a small group of people.

I would just love for a court to actually use the Constitution to decide whether a law is lawful under our US Constitution instead of using their ideologies and biases. If they would do that we would not have to worry about laws being overturned that shouldn't have been.

The Separation of Church and State Doctrine is ludicrous and has no basis in of Constitutional Law. It has been hotly debated for decades and as soon as we can get rid of the liberal judges this Doctrine will disappear.

The so called Right to Privacy doesn't exist in the US Constitution either and if we had judges with back bones we wouldn't have to worry about that either. But as long as we have spineless jellyfish liberal judges we will continue to save the same garbage rulings from the courts.

The only reference to Separation of anything that appears in the Constitution is the idea of Separation of Power between the three branches of the government; Executive, Judicial and Legislative.

Welfare System in America

I am probably going to anger some people that read this entry, but I am only speaking my mind on this subject that I believe is one of the biggest plagues on our society. I believe that too many American families are being trapped in a system that was meant to be assistance when it first introduced decades ago.

Now we have a system that is wrought with abuse and neglect that isn't assistance but subsistence. There are too many families that can actually support themselves but chose not too. Now, before you attack me and call me ignorant for saying people on welfare are all deadbeats and such that isn't what I am saying at all.

Not all families that are on Welfare are there because they are sponging off the taxpayers, there are other people that are on Welfare because circumstances beyond their control. My biggest issue is with the people that leach off the Welfare System and have kids just to increase the amount that they receive from Welfare. Those people need to be forced to find a job and then get off Welfare. I don't believe for a second that it was intended to be a way of life instead of a program to help families that are hit with hard times and need a way to get their feet back on the ground.

We spend so much money in this country to give people everything even though they are completely capable of supporting themselves but chose not to. Instead of giving these families everything for free they should be given incentives to get to work and support their families. Instead we make it more attractive for these people to sit on their collective butts and do nothing all day and take taxpayer handouts.

New Welfare Plan

The new program will be a one year assistance program designed to cover living expenses and medical bills in case of necessity. Note: this is provided that there is no medical disability that wasn't self inflicted.

Coverage Included in plan:

1)      Food Stamps
2)      Medical Insurance Coverage
3)      Child Care Assistance if necessary
4)      Job training/retraining
5)      Education assistance

Responsibility of Recipient

1)      To hold a job
2)      Attend skill enhancement classes

My view on the Constitution

I had a friend ask me in an email over the weekend what I thought the Preamble of the Constitution meant to me. I didn't really know exactly how to answer that question without going back and analyze what it says and how I feel about each of the parts of the Preamble. I do know that my understanding and opinion on what it means will differ from my friend and probably many of you that read my blog, but that is what makes our country so great. I am going to attempt to express my views on what the Preamble means to me as my friend asked me.

First off as theUnited States of America has grown over the decades since this document was first drafted to establish our Republic it has remained the framework for our existence as a nation. Now it really depends on what side of the fence you find yourself on as to how it has actually succeeded.If you are a strict Originalist which means you believe in a strict adherence to the words of the document or do you tend to believe that it is a living document that is designed to be interpreted to meet an ever changing society. I believe that we don't need to change how it is interpreted and applied.

I believe that we need to promote the general welfare of the people and not promote WELFARE in this country. I believe that we don't need to change the document to fit some people's ideals on how things should be.

 The concept of WELFARE had a purpose and because some individuals have taken advantage of the program and it has destroyed many areas in this country and it has created a society of Entitlement that is over burdening our Federal Government that doesn't need to be as big as it has become. I think it is more the State Governments responsibility to promote the General Welfare and Domestic Tranquility than the Federal Government and if they would take more responsibility for their residence we would be a lot better off. I think that it should be up to the States and Local Governments responsibility to give the people of the states and cities that they live in more opportunities to pursue their interests than they are doing.

 Now what I mean by that is that it is the responsibility to provide avenues for the residence to pursue their choice of recreation but not provide it at zero cost. We have over 290 million people in America and there is no way we tax payers can support that many programs to give everything away for free. I think the access to programs should be available to improve yourself but if you can afford them you should be expected to pay your way.

 If you cannot afford it at the time you should be afford assistance and pay back the assistance when and if you achieved the goal of the assistance. I believe the establishment of Justice is self explanatory and handled quite well by the Government and provide for common defense is also handled on both the Federal Level with our Armed Forces and on the State level with police forces and National Guard.

 I have been on this earth for 40 years and I haven't had an issue with the way our Federal Government has afforded me my liberty. I don't feel like any of my Liberties or Rights have ever been infringed upon in any way. I would imagine there are many people that watch the news on TV or read the newspaper that can point out how they feel that something has been passed by the Congress and signed into law by the President is somehow infringing on their rights.

But to me as an average citizen I can't remember any time that felt my daily life was in any way dictated by the Federal Government. I believe that it (Federal Government) should never intrude on my life until I somehow broke a rule or law and then I fully expect to have to answer for it.But I will not just speak out against something that doesn't have any bearing on my life or my family.

 If I want to donate of myself to a worthy cause then I am free to do so, but I will not force other people to do so just because I feel that it is a worthy cause or demand tax payers foot the bill. It is about time we the people take responsibility for ourselves and stop expecting the Federal Government to pay for everything. I seriously doubt that is what our Founding Fathers meant when they drafted the US Constitution. To me providing doesn't mean pay for, it means ensuring access to the service or what ever it is you need.

Federal spending gone amuck.

If the Democrats are really serious about bringing down the deficit and fix all the problems that we have in America they need to come up with a plan that will not raise taxes to fix the problem. We need both sides of the aisle to realize that in order to truly fix the problems we need to identify areas that can be reduced effectively to save tax dollars.

We have a group here in Oklahoma; OCPA which is a think tank made up group of people that have years of experience in economics and government organization. They are trying to push for the State Government to go on a spending diet to fix our funding problems by re-evaluating how each agency spends its money. As you would imagine that isn't going to happen as long as no one in the State Legislature agrees that it is necessary.

We need to apply the same Spending Diet Plan to our Federal Government. If we could eliminate billions of wasted tax dollars in one area we would have plenty of money to pay for programs that will actually benefit the American people that the government is supposed to be taking care of.

I think we need to start with Congress and put them all on a spending diet and probably save millions of dollars. They spend money like it is water and that there is an endless supply of it for their use. The problem comes in when they act like they are entitled to extravagant furnishings and vehicles to perform their duties that they are being paid handsomely for. If they were actually put on an expense report and accountable for what they claim I would imagine they would be a lot more frugal with their spending.

They already are costing each tax payer dearly for their healthcare plans and retirement plans so you would think they would be a lot more careful about they spend our money in their day to day work. I really don't understand why we actually pay them so much money when in fact they are able towork at their other careers even while they are being paid to be a Congressman or Senator.

I would love to see the voters impose a term limit law into the US Constitution and rework the outrageous healthcare and retirement plan that was created by congress for them, but is paid for by the taxpayers.

Democrats have no clue

It seems to me that the Demorats prey on simple minded people that only care about themselves and their selfish needs when they go after the Republican's. They speak in general terms and almost always claim that the Republican's do everything in the name of Big Business. The problem with their thinking is that not all people think like that and it is evident by many of the past elections.

Many Demorats lost elections because they made outlandish claims against their Republican opponents in hope that the voters would buy into their lies instead of actually offering a platform of their own that would actually work.

I would actually love to see the Demorats run on a platform that includes ways to fix problems that doesn't include raising taxes in order to pay for their new promises they came up with to woo voters. A good example of this in the past two Presidential Election Cycles the Demorat hopeful try to tout President Bush's tax cut plan was a boon to big business and a detriment to American people. They each used a variation on the same tired concept and neither one worked. At the same time that they were attacking Bush's tax cut plan they were touting a new Universal Healthcare Plan that would pickup the slack of the uninsured Americans. The problem is this Healthcare Plan would have grown the size of the Federal Deficit by over 2 trillion dollars and it would have to be paid for by the taxpayers.

The only thing they would say about how it was going to be paid for was to say that they would reverse all of the tax cuts and raise taxes on the segment of the population that already pays nearly 70% of the Income Tax in America. The one thing that they fail to realize that if they reverse the tax cuts and pound the wealthy with more taxes the result will be exactly what we got at the end of Bill Clinton's term in the White House; an economy in the toilet (recession bound) unemployment at 5.5%.

When George W. Bush took office the economy was almost at a stand still and rolling toward the eventual recession that we ended in and all of the Bush haters and Demorats tried to pin it all on Bush. When in fact it was all the smoke and mirrors that Clinton created Surplus with his creative tax plans that punished the wealthy hoping that by only hurting the wealthy that the middle class and working poor wouldn't complain so much if their taxes were increased at a much lower rate.

This is why we have so many of the Bush haters thinking they had it so well under Bill Clinton in the 1990's because he put most of the tax increases on the backs of the wealthy and gutted our Military and Intelligence Agencies and both lead directly to 9/11 and the subsequent problems with military troop strength we are running into now.

I am hoping that by the time 2008 comes around and the deficit is sitting at zero the American people remember that it wasn't the Democrats in Congress that would have gotten us there; instead it was the American businesses and the people that reduced the deficit.

Democrats gone wild

I dread the day that the Democrats steal the White House from the Republican's we will be in desperate trouble as a society. I say that because our taxes will go through the roof and they will disguise the need for the higher taxes just so they can pay for universal healthcare that we don't need and the economy will go into the toilet just like Bill Clintoon did.

All these liberal nut jobs want to blame President Bush for the deficit and so called poor economy. The problem is the poor economy is a lie and deficits are nowhere near as bad as Recessions and Depressions. President Bush proved that we can cut taxes and still grow the economy and reduce deficits all at the same time. The Demorats all cried foul and tried to convince the American people that Bush tax cut only benefited the rich (Top 1% under Gore and Top 2% with Kerry) and the American voters saw through their lies both times.

The tax cuts are single handedly responsible for reducing the deficit by nearly $100 Billion dollars and it will be even more next year. Still the Demorats and liberal Bush haters will not give him credit for what he has done. They will continue to focus on the War in Iraq, Afghanistan and WMD's as reasons to hate him.

I am pretty just ignore the Leftist Extremists in this country and focus my energy on the things that matter to me; my family. I really don't pay much attention to the morons that spend every waking hour in AOL chatrooms and spout their venom and hatred of George W. Bush and how bad the Republican Party is.

I mainly go into the chatroom for the sheer entertainment value of what they have dreamed up in their feeble little minds. They offer no intelligent reasons why they don't like Bush except to say that he is dumb and can't speak proper English so he must be an idiot of some sort. Have they listened to Ted Kennedy lately, he slurs his speech quite a bit lately like he needs to knock off the liquid lunch.

Hilary Rotten Clintoon sounds like a raving lunatic when she speaks and she goes off on a tangent to say negative about Bush and the Republicans.

If the Demorats would actually offer a better solution to some of the most pressing issues I would actually listen to them, but they spend more time slamming the Presidents and Republican's to actually offer a better plan for Social Security. Their solution is raising more taxes and continue to spend the same as usual.

Supreme Court Nominee

Demorats make me sick to my stomach when they act like little children when they don't get there way in Washington. They lose elections and they think they have to take it out on the Republican Party for their losses. Instead of figuring out that it is their social philosophy that they lose the election and not their opponents.

They are too busy trying to manipulate the voters into voting against the Republican Party they forget that they actually have to have a better way of doing things in Washington. The problem lies with their lack of any substantial plan to actually fix anything that is truly wrong in America.

They like to say the Republican Plan to fix this problem is just a benefit or boon for Big Business and yet they don't offer an actual solution that is a benefit to anyone. That is because their answer is usually raise taxes and put more money into the program to fix it.

The latest example of Demorats losing the election so they are trying to stick it to the Republican Party by attempting to influence or control the selection of a Supreme Court Justice. One of the single most important tasks that is given to the President of the United States by the US Constitution is appointing Justices to the US Supreme Court.

Not all Presidents have had the honor to fulfill this duty since a Supreme Court Justice is a lifetime appointment or until they chose to retire. The Senate in one of the many Checks and Balances features we have in our US Constitution has the task of confirming a nominee for the US Supreme Court.

The problem lies in the way that the Demorats go about the confirmation process for all judicial position for the past decades and even more so for most judges while President George W. Bush has been in office. They have been using the judicial confirmation process as a way to get back at the President and the Republican Party since they have been losing election left and right.

Instead of actually looking at whether the judge nominee is actually qualified to sit on the bench that they are being nominated for they ask them what their views are on certain specific ideologies and if the aren't Left enough they aren't going to even get a vote on the Senate floor. The use the filibuster provision to not even allow a vote. This is because a filibuster requires a Super Majority in the Senate Committee to even go to the full Senate for a vote, even though a judicial nominee only need a simple majority in the full Senate vote to be confirmed. But because they use the filibuster they are actually changing the rules of the nominee process that is established in the Constitution and making the nominee have to pass a Super Majority which is a violation the procedures of Judicial Confirmation in the Constitution.

With the resignation of Justice Sandra Day O'Connor  a couple of weeks ago puts President Bush in a great position to shape the Supreme Court for many years to come and hopefully his nominee for the position is confirmed and we get a Conservative on the bench to counteract the Leftist Activist Justices that are destroying our society by reversing many laws that have been at the heart of our morally just society and causing the moral decay our society to multiply.

The problem is the Demorats in the Senate have already circled their wagons to find a way to attack Mr. John Roberts Jr. before he answers a single question. The hatchets are already being sharpened by the Demorats in the Senate and they are going to go after him with a vengeance and attack his credibility and trying to pre qualify him based on their ideology and not on his ability to uphold the Constitution and to interpret the Constitution as it applies to the laws that are being challenged.

They will ask him how he feels about Roe v. Wade and whether he would vote to over turn it or any of number of our hot button topics like that and if they don't get the answer they want they will attempt to railroad him and not confirm him. Their responsibility is not to make sure that the nominee shares their twisted agenda or ideology it is to be sure that he can fairly judge a case on its Constitutionality or not.

Reforming our tax code!!

It is about time that we start a debate about something that is really worthwhile in the country and it has nothing to do with the president's fitness to lead or the War in Iraq. It has to do with something that will affect just about every American citizen and it needs to be fixed. What I am referring to is Income Tax and the solution to a system that is broken and ineffective.

The tax code is bloated and filled with so many loopholes that it needs to be completely rewritten and now. I have heard a couple of options that I like and I would like to discuss them and give my option on which one I would like to see work. I will be using information taken directly from the sources so I don't include incorrect information.

The biggest reason I think that the current tax system doesn't work is that it is unfairly applied and it has been for so many years been used by politicians from the Demoratic Party to get votes that it is criminal in my humble opinion. They use the wealthy to fund all of their boondoggles so when it comes time for election the can go before the voters and act like they are the best friend of the majority of the American voters. This is because 69% of the personal Federal Income Tax is paid by the Top 2% of American wage earners. So with those numbers in mind if they impose a special set of taxes that apply to only the Top 1% of the wage earners the Federal Government can collect a huge amount of revenue without affecting the majority of Americans.

Now that may appeal to a lot of people, but it is one of the most unfair systems we have and it needs to be fixed. I feel that the only way to fix the tax system and keep the Federal Government running is to not tax Personal Income instead we need a National Retail Tax. This would capture BILLIONS of dollars that are not being collected due to the many loopholes in the current Income Tax system.

I would much rather keep all of my income every week and pay only a sales tax on what I buy rather than pay income tax on what I make. Consider the trillions of dollars worth of goods that are purchased every year at the retail level and how much money can be generated from a tax on those sales. This would easily exceed what the government steals from you and I every week in the form of Income Taxes.

It makes so much sense on any level that if we have more of our money to spend we will spend it and that makes it a win-win situation for everyone. The two big winners will be the American people and businesses that provide the merchandize for us to purchase. The big losers will be the money grubbing Demorats in Congress that won't have our money to play around with.

I think that our current tax system is much more of a penalty based system that by its very nature penalizes American's for achieving more in life and for stifles small business growth. This was one of the major themes behind President Bush's tax cut plans that met with so much Demoratic opposition; he wanted to lower the taxes on the very segment of our population that creates a majority of the new jobs in America. That segment is wealthy small business owners. They account for the largest segment of job creators and not the large conglomerates.

The theory is very sound, but the Demorats just couldn't allow President Bush to give tax cuts to their Cash Cows. After all these are the people that Bill Clinton used to create his so called Surplus of dollars in the Federal coffers. On top of the new taxes Bill Clinton gutted our military even further than George H.W. Bush did and Clinton also gutted the FBI and CIA to the point that 9/11 was allowed to happen.

So when Bush started talking about wanting to start by giving 30 million tax payers tax break and also wanting to repeal the other taxes that applied to mainly the wealthy they started their smear campaign against Bush and said his tax break plan saying that it only benefited the "Top 1%" of Americans and it wasn't fair.

1. Individuals would not file. Businesses would need to deal only with sales tax returns.

2. Millions of Americans who hire tax accountants to navigate the 4,000-plus pages of the tax code each year would be spared the expense.

3. No more taxes on wages, savings and investments. That alone would increase productivity and result in significant economic growth.

4. As a consumption tax, the amount you pay in taxes would depend on your lifestyle. The more you spend the more you pay, and vice versa. All taxes would be rebated up to the poverty level.

5. Foreign companies would be forced to deal on even terms with American companies for the first time in 80 years. Under the current code, U.S. exports bear an unfair burden, with no adjustment to account for the tax advantages of imports.

Newsweek's blunder    

I think it is quite amazing how the outrage has died down over the desecration of the Koran and Newsweeks accepting responsibility for the error.

Over the weekend we heard nothing but damnation of the
and the military over this suspected act of blasphemy against the sacred book of the Islamic faith. I personally think it is ridiculous that a segment of the population screams bloody murder about Separation of Church and State anytime religion is mentioned with the government and then this happens and our government supports sacred treatment of this book just to keep the peace with the Muslims.

I say that is BS and we should be able to burn their book if they can burn our flag in protest and we don't condemn their actions.

We are able to burn the flag legally only because the Courts are afraid to stop it and yet they will remove prayer in school and anywhere else that is even remotely supported by a government agency even though it is not mentioned any where in the Constitution.  

It is truly amazing how Newsweek is allowed to continue to operate in this country after it committed an outrageous act against the people of the United States in the eyes of Muslims across the world. But I guess that is what makes our great country great; we have the freedom of speech. That means we can say just about whatever we want about anyone we want and get away with it. There are exceptions of course; can't yell fire in a crowded movie theater unless there is actually a fire and you can't use the "n" word unless you are black.

 

Demorats illegal use of the filibuster

 

I think we should remove every liberal minded judge from every court in the United States and replace them with conservative or moderate judges. That should fix all the ills in this great country of ours. Of course that would never happen since the Demorats would never let that happen in a million years.

 

I hope to god Senator Frist is able to get the full Senate to vote on the two Federal judges that President Bush has nominated to fill vacancies on the benches. The Demorats have been successfully blocking their confirmation votes by filibustering. The problem with the use of the filibuster for these Judges it is a direct violation of the Constitution and it should be removed. The reason I believe it is a violation is because the Constitution spells out under which conditions a Super Majority (60 Senators) to pass a piece of legislation. Judicial nominations is not one of those selected votes that require a Super Majority, but in order to break a filibuster you have to have a Super Majority so in essence they are requiring these Judicial nominees to have Super Majority before they can even be voted by the full Senate for confirmation. This is at the heart of the argument and the Demorats don't think that people are smart enough to realize that is in fact what they are doing. The problem is most of the liberals and Demorats aren't smart enough to realize that is exactly what they are doing.

Demorat vs. Republican

 

I have been thinking about this topic for quiet sometime and I decided to put down some of my thoughts on the subject. I was raised by parents that are admittedly Democrats and as I grown up I find myself on the opposite end of the spectrum of them. I don't hold it against my parents that they are Democrats, but I just don't understand how anyone can think like a liberal Demorat.

For some reason they (Demorats) think that what I earn somehow should be spent on those who don't want to earn a living and support their families. Now mind you I am by no means part of the top 1% or 2% wage earners in America, but every penny that is taken out of my paycheck goes to support those who don't support themselves. If I had my way we wouldn't have payroll taxes and the States would support all of their residents and the Federal Government wouldn't be in the support business.

I feel like most Republicans do that we are responsible to support our families and the government is responsible for infrastructure and nothing more. But due to all the bleeding heart liberals in Congress and across the country we are stuck supporting all the worthless people that refuse to work and support their families. I have no problem with short term assistance in the case of spousal death or even divorce, but this welfare system that was created is a disaster and needs to be fixed. The idea that families can not work and collect money enough to live and a family with single or two bread earners can't support themselves is a travesty.

The Republicans are trying to give people more money every month to spend which will in turn grow the economy. The Demorats want to keep taking more tax dollars so they can give it away and disguise it as Universal Healthcare (Socialized Medicine) and Welfare. Those twothings won't encourage business growth in America which provides more jobs that are badly needed in some impoverished areas. The Demorats answer to that is if we collect more tax dollars we will be able to give all of away to the people that refuse to work.

Our economy is based on Capitalism and not Socialism and it is a shame that the Demorats don't seem to want to accept that theory. Bill Clintoon created this mess and now that President Bush is trying to fix it all the liberals and Demorats are fighting it tooth and nail. Clintoon created two messes and took responsibility for neither; over taxation of the wealthy and a recession that has taken its toll on our society as a whole.

Smoke and Mirrors

I like to call Clintoons Tax Surplus "Smoke and Mirrors" for a couple of reason; one of those reasons was he created a bunch of new taxes that on surface only hurt the wealthy, but in fact hurt more people than we thought. The second reason was that it was only on paper and really never materialized and put our economy into a recession that all the liberals tried to blame on Bush after he took office.

The problem with Clintoon's tax on the wealthy is that they had less money to put into the businesses that they owned and that stunted the growth of the economy and in turn brought in less new tax revenues that Clintoon needed for his Surplus. So as the new revenues dried up less jobs were created and more of the companies profits dwindled and they were forced to cut jobs. But of course these job cuts occurred after Clintoon left office and again all the liberals and Demorats put the blame on the new President that took office.

Over taxation of the wealthy

I don't quite understand how the Demorats think that we should reward people for succeeding in life by paying a higher rate of taxes, but for some reason they think like that. With that said, do I believe that a person making more money should pay more intaxes. The difference between me and a liberal Demorat is that I believe that the rate at which everyone is taxed should be exactly the same. That means if I make $25,000.00 year and you make $50,000.00 per year, you will pay more in taxes than I do. But the Demorats think that just because you make more money your tax rate should be much higher and therefore they will collect much more tax revenue to waste on unneeded entitlement programs that they created the need for in the first place.

The way to insure that everyone pays their fair share is to eliminate all tax shelters and loopholes and tax every dollar you earn or do away with payroll taxes altogether and go to a sales tax system that taxes all goods and services sold in America at a predetermined percentage. This will in essence eliminate the need for a big part of the Federal Government (The IRS) and save BILLIONS of dollars. If we simplify the tax code in America it will fix many of the problems we have and reduce the size of the Government which in turn will require less tax dollars to run.

The Demorats have their solution to every problem at the Federal Government level and that is raise taxes and throw more money at the problem and it will go away. I have one thing to say to that solution 'How has it been working so far", not at all. I say instead of throwing more money at the problem and praying that it will go away, actually look at the problem and find a way to fix the problem with the same amount of money.
